Bottom line

High confidence

The Court's binding constraint is now payments, not jurisdiction

OFAC added the International Criminal Court itself to the SDN List on 9 Oct 2026 under the ICC program (EO 14203) V. General License 13 keeps salaries, state contributions, rent and routine services lawful until 12:01 a.m. EDT, 7 Apr 2027 V. That date is the cliff. Bank and vendor de-risking decisions will be made in the five months before it, not after A.

High confidence

Duterte goes to trial on 30 November

Trial Chamber III found him fit on 8 Oct 2026, removing the defence's last lever for delay V. It will be the first trial of a former head of state at the ICC since Gbagbo's acquittal in 2019 A. OFAC's detainee licence (GL 16) names him, so the sanctions do not interrupt his detention V.

Moderate confidence

The Palestine warrants are the bargaining object

Washington cites the Netanyahu and Gallant warrants and the Afghanistan probe as grounds for the designation R, and its carve-outs exist to give states parties time to show "meaningful progress" R. The pending Article 19 ruling at Pre-Trial Chamber I is the one decision that could give both sides a face-saving exit A.

Low–moderate confidence

Membership erosion is real but reversible

Five withdrawal notices are pending, all taking effect June–July 2027 V. Hungary reversed its withdrawal days before it took effect, after a change of government V. Expect one to three more notices from US security clients before April 2027 S, and treat each as tied to the government that filed it.

The Court on the SDN List

Designation of the International Criminal Court · 9 Oct 2026 · ICC-Related Sanctions Regulations, 31 CFR part 528 · General Licenses 13–16 issued the same day

Analytical question. Can the Court keep paying staff and running trials past 7 Apr 2027, and what does Washington want in exchange for extending the licence?

What the licences allow

LicenceCoversExpires
GL 13Transactions needed to maintain or wind down the Court's operations: state-party contributions, salaries, health cover, rent, utilities, taxes, insurance, routine services7 Apr 2027
GL 14Telecoms, internet services (email, video, hosting) and enterprise software including cloudNone stated
GL 15Pension payments, into a blocked US account where the payee is blockedNone stated
GL 16Detention of nine named detainees, including health, safety and facility operationsNone stated

Each licence lets the Court's blocked accounts be debited or credited for the covered purpose, and none covers dealings with the 13 individually designated officials V.

Design of the instrument

The open-ended carve-outs protect the things that would embarrass Washington: detainee welfare, pensions, the Court's email. The one licence with a date is the one that pays for judicial work. That reads as a lever with a timer, not a shutdown order A.

Pressure timeline, Nov 2024 to Dec 2027

Solid marks are issued or filed. Open marks are fixed future dates. Hatched bands are Azimuth estimates. The crimson line is the GL 13 expiry.

The leadership vacuum

Prosecutor removed

The Assembly removed Karim Khan on 24 Jul 2026 by 82 votes to 13 with 15 abstentions, the first removal of a sitting ICC Prosecutor R. An oversight finding of serious misconduct in June 2026 outweighed a March 2026 judicial-expert panel that found the investigators' facts did not establish misconduct R. Khan says he will challenge the removal, possibly at the ILO Administrative Tribunal R.

Who decides now

The Office is run by two sanctioned Deputy Prosecutors, and nine of eighteen judges are designated R. Every senior decision-maker on the Palestine file already operates under US sanctions, so further designations of individuals add little leverage. That explains the move to the institution A.

Competing hypotheses for 7 April 2027

H1Rolling extension. OFAC reissues GL 13 for short periods while pressure continues. The Court keeps functioning at reduced capacity and with rising banking friction. OFAC routinely re-extends wind-down licences, and the licence text frames the carve-outs as time for states to act.Leading
H2Negotiated narrowing. Something Washington can call progress, such as a PTC I ruling for Israel on Oslo-based jurisdiction or a Prosecutor acceptable to the US, buys a longer licence or delisting. The pending Article 19 ruling makes this available without any state having to act.Material
H3Hard expiry. GL 13 lapses, European banks with US operations exit, and the host state and central banks have to improvise payment channels. Trials slow and staff leave. Supported by the escalation pace: a new step roughly every two months since June 2025.Material
H4European legal counter. The EU extends the Blocking Statute to ICC measures, putting EU banks under conflicting legal duties. The Commission has been assessing this since February 2026 without acting.Less likely by April

Evidence against H1: Rubio's stated aim is to dismantle the Court, not change its behaviour, and the President has called on states to leave. If the aim is dismantling, an extension is a delay, not a deal.

Transmission channels

  • Banking. Any bank with US operations that services the Court after 7 Apr 2027 takes on US enforcement risk, even for euro payments. Dutch and other European banks are the exposure point A.
  • State contributions. GL 13 expressly covers payments from states parties to the Court until April V. Treasuries paying their 2027 assessments after expiry will have to route around banks with US exposure A.
  • Service providers. Defence counsel, victims' lawyers, experts, translators and NGOs that work with the Court now deal with an SDN. The program already reaches beyond officials: it has designated a UN special rapporteur and Palestinian rights groups R.
  • Compliance screening. "International Criminal Court" is now a live SDN hit in payment screening, including staff salaries, pensions and contractor invoices A.
  • Travel and arrest risk. Hungary's reversal restores its duty to arrest. Netanyahu's and Putin's travel to states parties remains the visible test of warrant enforcement A.

Indicators and falsifiers

  • Toward H1: an OFAC FAQ or GL 13A extending or clarifying the window; Dutch banks confirming continued service.
  • Toward H2: a PTC I ruling on Article 19; a prosecutorial shortlist without names already under designation; quieter US statements after ASP 25.
  • Toward H3: designation of a bank, payment processor or state-party official for supporting the Court; new withdrawal notices on the UN depositary record; trial postponements attributed to logistics.
  • Toward H4: a Commission proposal to amend the Blocking Statute annex.
  • Falsifier of the cliff thesis: OFAC drops the GL 13 expiry date or delists the Court.

Intelligence gaps

  • The ICC website and court records were unreachable for this pull. ICC events rest on OFAC documents, ICC statements quoted in press, and dated reporting.
  • OFAC's press release and FAQs for 9 Oct were not read; only the four licence texts were.
  • Whether PTC I has ruled on Article 19 in 2026 is unconfirmed.
  • Which banks hold the Court's accounts is not public.

Source reliability flags

  • One explainer dates the Netanyahu warrants to "early 2025"; they were issued 21 Nov 2024.
  • One sanctions newsletter cites "EO 14023"; OFAC lists the Court under ICC-EO14203.
  • A Sep 2026 report that a panel "found no misconduct" describes the March 2026 panel, before the removal vote. It is not a later exoneration.
  • One legal journal calls Judge Akane President of the Appeals Division; other reports describe her as President of the Court.

Withdrawals

A withdrawal takes effect one year after the UN Secretary-General receives notice. It does not discharge obligations or end investigations that began before then.
